The copyright law usually obliges the photographer to give credits of his photograph. That usually means that he must provide a description of the depicted objects and its authors. However, he can be exempted from the obligation when the authorship is difficult to deduce. For instance, German copyright law says in §62 that the photographer needs not provide the credits if they are not clearly present on the object that is depicted.

Tot 2016 bestond geen panoramavrijheid in België; een rechthebbende kon zich verzetten tegen de publicatie van afbeeldingen van publiekelijk zichtbare werken zoals gebouwen. Pas 70 jaar na de dood van de bedenker verviel de algemene auteursrechttermijn en viel het werk vanaf dan in het publiek domein. Eind 2015 echter dienden leden van Open Vld, CD&V en N-VA een wetsvoorstel in om de panoramavrijheid in te schrijven in het Wetboek van economisch recht (artikel XI.190, 2/1°). Deze vrijheid slaat wel enkel op werken die permanent in het openbaar domein aanwezig zijn en op afbeeldingen van het werk zoals het zich in de natuurlijke omgeving bevindt. Op 16 juni 2016 keurden de meerderheidspartijen in de Kamer van Volksvertegenwoordigers dit wetsvoorstel goed. Er waren 42 tegenstemmen van de oppositiepartijen PS, sp.a, PVDA, cdH en DéFI. De leden van Ecolo en Groen onthielden zich. Tevens werd een amendement van de PS om dit te beperken tot puur niet-commercieel gebruik verworpen. De wetswijziging van 27 juni 2016 werd gepubliceerd op 5 juli en trad in werking op 15 juli 2016.
